1. Agreement to Terms

These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement between you ("Customer", "You", "Your") and Plotsque ("Company", "We", "Us", "Our") regarding your access to and use of our website, mobile application, and services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our Services.

These Terms apply to all users, including customers, visitors, and others who access or use the Services.

2. Definitions

  • "Services" means all plot maintenance, monitoring, and management services provided by Plotsque, including but not limited to plot cleaning, wall construction, plantation, monthly maintenance, drone surveys, and legal assistance.
  • "Subscription" means a recurring service plan (Basic, Standard, or Premium) with monthly billing.
  • "One-Time Service" means a single, non-recurring service engagement for specific tasks.
  • "Property" or "Plot" means the vacant land for which you have engaged our Services.
  • "Customer Portal" means the online dashboard where you can access reports, photos, and manage your account.
  • "Field Supervisor" means Plotsque's authorized personnel who visit and maintain your property.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Services. By using our Services, you represent and warrant that you meet these requirements.

3.2 Account Creation

To access certain features, you must create an account by providing:

  • Accurate and complete personal information
  • Valid contact details (email, phone number)
  • Property information and location
  • Proof of property ownership or authorization (when requested)

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Use a strong, unique password
  • Not share your account credentials with others
  • Notify us immediately of any unauthorized access
  • Keep your contact information up to date

4. Services Description

Plotsque provides comprehensive plot management and maintenance services tailored for NRIs and remote property owners:

4.1 Subscription Services

  • Basic Plan (₹699/month): Monthly visits, geo-tagged photos, condition checklist, quarterly grass trimming
  • Standard Plan (₹1,299/month): Fortnightly visits, video + photos, monthly grass cutting, annual drone report, dashboard access
  • Premium Plan (₹2,999/month): Weekly visits, quarterly drone surveys, AI alerts, legal referral, dedicated manager, emergency visits

4.2 One-Time Services

  • Plot cleaning and tree removal
  • Boundary wall construction and fencing
  • Plantation with drip irrigation setup
  • Drone scanning and aerial surveys
  • Legal documentation and survey assistance

4.3 Service Deliverables

All services include:

  • Geo-tagged photos with GPS coordinates and timestamps
  • Detailed inspection reports (PDF format)
  • Real-time updates via Customer Portal
  • Professional documentation and record-keeping

5. Subscription Terms

5.1 Billing and Payment

  • Subscriptions are billed monthly in advance
  • All fees are in Indian Rupees (₹) and exclusive of applicable taxes
  • Payment is due on the subscription start date and each renewal date thereafter
  • Accepted payment methods: Credit/debit cards, UPI, net banking, Razorpay, Stripe
  • Failed payments may result in service suspension after 7 days

5.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method for renewal fees.

5.3 Plan Changes

You may upgrade or downgrade your subscription plan at any time:

  • Upgrades: Take effect immediately with pro-rated charges for the current billing period
  • Downgrades: Take effect at the start of the next billing period
  • Plan changes can be made through your Customer Portal or by contacting support

5.4 Cancellation

You may cancel your subscription at any time through your Customer Portal or by contacting us. Cancellations are subject to the following terms:

  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial months
  • You retain access to Services until the end of the paid period
  • All inspection reports and data remain accessible for 90 days post-cancellation

6. One-Time Service Terms

6.1 Booking and Payment

  • One-time services require full payment in advance before work begins
  • Custom projects may require a 50% advance payment with the balance due upon completion
  • Quotes are valid for 30 days from the date of issue
  • Prices are subject to change based on site inspection findings

6.2 Service Timeline

We provide estimated timelines for all one-time services. Actual completion may vary based on weather conditions, site accessibility, and project scope. We will notify you of any significant delays.

6.3 Warranty

We provide a 90-day workmanship warranty for construction services (walls, fencing). This warranty covers defects in materials and workmanship but does not cover damage caused by natural disasters, vandalism, or normal wear and tear.

7. Property Access and Customer Responsibilities

7.1 Property Access

By engaging our Services, you grant Plotsque and our authorized Field Supervisors the right to access your property for service delivery purposes. You agree to:

  • Provide accurate property location details and access instructions
  • Ensure unobstructed access to the property during scheduled visits
  • Notify us of any access restrictions, locked gates, or security requirements
  • Inform local authorities or security personnel of scheduled visits if necessary

7.2 Property Ownership

You represent and warrant that you:

  • Are the legal owner of the property or have proper authorization from the owner
  • Have the right to engage third-party services for the property
  • Will provide ownership documentation if requested
  • Are responsible for all property-related legal matters and disputes

7.3 Accurate Information

You agree to provide accurate, complete, and up-to-date information regarding:

  • Property location, size, and boundaries
  • Contact information for emergencies
  • Special requirements or concerns
  • Changes to property ownership or access

7.4 Communication and Cooperation

You agree to:

  • Respond promptly to our communications (within 48 hours for non-urgent matters)
  • Review inspection reports and provide feedback
  • Report any issues or concerns in a timely manner
  • Maintain a valid payment method on file
  • Treat our staff with respect and professionalism

8. Service Delivery and Performance

8.1 Our Commitments

Plotsque commits to:

  • Conduct scheduled visits as per your subscription plan
  • Provide geo-tagged photo and video documentation within 24-48 hours of each visit
  • Upload inspection reports to your Customer Portal within 48 hours
  • Respond to customer inquiries within 24 hours (business days)
  • Notify you of any issues, concerns, or recommended actions
  • Maintain professional standards and quality in all services

8.2 Service Delays and Force Majeure

Service delivery may be delayed or temporarily suspended due to circumstances beyond our reasonable control, including but not limited to:

  • Extreme weather conditions (heavy rain, storms, floods)
  • Natural disasters or acts of God
  • Government restrictions, lockdowns, or emergencies
  • Property access issues or security concerns
  • Equipment malfunction or technical failures

We will notify you of any significant delays and reschedule services as soon as reasonably possible. No refunds or service credits will be provided for delays caused by force majeure events.

9. Pricing and Fees

9.1 Current Pricing

Our current subscription and service pricing is available on our website and through the Customer Portal. All prices are in Indian Rupees (₹) and are subject to applicable taxes.

9.2 Price Changes

We reserve the right to modify our pricing at any time. For existing subscribers:

  • We will provide at least 30 days' advance notice of price increases
  • New prices take effect on your next billing date after the notice period
  • You may cancel your subscription before the new prices take effect without penalty
  • Continued use of Services after a price change constitutes acceptance of the new pricing

9.3 Taxes

All fees are exclusive of applicable taxes (GST, service tax, etc.). You are responsible for paying all applicable taxes associated with your use of our Services.

9.4 Additional Charges

Additional charges may apply for services outside the scope of your plan, including emergency visits, urgent inspections, or special requests. We will notify you of any additional charges before providing such services.

10. Refunds and Cancellation Policy

Our refund and cancellation policies are detailed in our separate Refund & Cancellation Policy. Key points include:

  • Subscription refunds are provided only in specific circumstances (service not delivered, misrepresentation)
  • One-time services: 100% refund if cancelled before work begins, 50% refund if work has started, no refund after completion
  • Refund requests must be submitted within 7 days of the issue
  • Refunds are processed within 7-14 business days to the original payment method

11. Intellectual Property Rights

11.1 Plotsque IP

All content, materials, and intellectual property on our website and Services, including but not limited to text, graphics, logos, images, software, and design elements, are owned by or licensed to Plotsque and are protected by copyright, trademark, and other intellectual property laws.

11.2 Service Content License

All photographs, videos, reports, and documentation created by Plotsque during service delivery remain our intellectual property. However, we grant you a non-exclusive, non-transferable license to:

  • Access and view the content through your Customer Portal
  • Download and save content for personal property management purposes
  • Share content with relevant parties (lawyers, real estate agents) for property-related matters

11.3 Prohibited Uses

You may not:

  • Reproduce, distribute, or publicly display our content without permission
  • Use our content for commercial purposes or resale
  • Modify, reverse engineer, or create derivative works from our Services
  • Remove or alter any copyright, trademark, or proprietary notices

12. Limitation of Liability

12.1 Service Limitations

Plotsque provides monitoring and maintenance services designed to help protect your property. However, we cannot guarantee prevention of all issues. We are NOT liable for:

  • Encroachments, theft, vandalism, or illegal activities occurring between scheduled visits
  • Property damage caused by natural disasters, acts of God, or environmental factors
  • Actions or inactions of third parties beyond our control
  • Property boundary disputes, ownership issues, or legal matters
  • Loss of property value or missed opportunities
  • Delays or failures caused by circumstances beyond our reasonable control

12.2 Maximum Liability

To the maximum extent permitted by law, our total aggregate liability for any claims arising from or related to these Terms or our Services shall not exceed the total amount paid by you to Plotsque in the 12 months preceding the claim.

12.3 Disclaimer of Warranties

Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that:

  • Services will be uninterrupted, error-free, or completely secure
  • Results obtained from Services will be accurate or reliable
  • All property issues will be detected or prevented
  • The Customer Portal will be available at all times

13. Indemnification

You agree to indemnify, defend, and hold harmless Plotsque, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Inaccurate or misleading information provided by you
  • Property ownership disputes or legal issues
  • Your use or misuse of our Services

14. Privacy and Data Protection

Our collection, use, and protection of your personal information is governed by our Privacy Policy. By using our Services, you consent to our privacy practices as described in that policy.

We implement reasonable security measures to protect your information but cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

15. Termination

15.1 Termination by Customer

You may terminate your subscription at any time through the Customer Portal or by contacting us. Termination takes effect at the end of the current billing period.

15.2 Termination by Plotsque

We reserve the right to suspend or terminate your access to Services immediately, without prior notice, if:

  • Payment is not received after multiple reminders and a grace period
  • You violate these Terms or engage in fraudulent activity
  • You provide false or misleading information about property ownership
  • You engage in abusive, threatening, or harassing behavior toward our staff
  • Continued service delivery poses safety or legal risks

15.3 Effect of Termination

Upon termination, your access to Services and the Customer Portal will cease. Inspection reports and data will be available for download for 90 days post-termination, after which they may be permanently deleted.

16. Dispute Resolution

16.1 Informal Resolution

If you have any concerns or disputes regarding our Services, please contact us first at hello@plotsque.com or +91 9618144466. We commit to working in good faith to resolve issues promptly and fairly.

16.2 Arbitration

If informal resolution is unsuccessful, any disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Hyderabad, Telangana, India.

16.3 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes not subject to arbitration shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending email notification to active customers
  • Displaying a notice in the Customer Portal

Your continued use of Services after the effective date of the updated Terms constitutes acceptance of those changes. If you do not agree to the modified Terms, you must cancel your subscription and stop using our Services.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Plotsque regarding your use of our Services and supersede any prior agreements.

18.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

18.5 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated herein.
